1. Acceptance of these Terms
These Terms of Use (“Terms”) govern access to and use of SoulSaga, a product operated by Itera Studio LLC (“Itera,” “we,” “us”). By creating an account, starting a waitlist reservation, or using SoulSaga, you agree to these Terms. If you do not agree, do not use the service.
2. Nature of the service
SoulSaga is software that supports personal reflection and introspective writing with AI. It offers a space for free expression and helps shape your thoughts into a story. Chapters are narrative interpretations based on your text — not absolute truth, clinical advice, or professional counseling.
Important medical disclaimer
SoulSaga is not a medical, psychological, or therapeutic device. The AI does not diagnose and never replaces a qualified mental-health professional. If you are in crisis or severe distress, contact emergency services or a professional in your region immediately.
3. Your account
Access currently uses Google sign-in. You must provide accurate information and keep your Google account secure. You are responsible for activity under your SoulSaga account. We may suspend or terminate accounts that violate these Terms, abuse the service, attempt to circumvent billing, or create risk for Itera or other users.
4. Your content and license
You retain ownership of what you write and of chapters generated from your entries. You grant Itera a limited, worldwide, non-exclusive license to host, process, and display that content solely to provide and improve SoulSaga for you (including AI generation needed for the product). We claim no ownership of your personal story and do not sell it.
5. Acceptable use
You agree not to: use SoulSaga for unlawful purposes; upload content you do not have the right to share; harass others or distribute malware; scrape, reverse engineer, or overload the service in a way that harms availability; bypass payment, usage limits, or security controls; or misrepresent AI output as professional advice. We may investigate and take action, including content removal and account termination, for violations.
6. Subscriptions, trials, and payments
Paid plans (monthly or annual) and free trials are billed through Stripe. You authorize Stripe to charge your payment method for the selected plan and applicable taxes. You can cancel or manage billing in the Stripe customer portal; cancellation stops future renewals according to the plan timing. Features depend on your plan and remaining free credits. Except where mandatory consumer law requires otherwise, fees are non-refundable once a billing period has started. Chargebacks filed in bad faith after legitimate use may lead to account suspension.
7. Availability and exports
We aim to keep SoulSaga available and secure but do not guarantee uninterrupted access. Please use export features to keep a personal copy of your story. We are not liable for delays or failures caused by events beyond our reasonable control.
8. Disclaimer and limitation of liability
SoulSaga is provided “as is” to the fullest extent permitted by law. To the maximum extent permitted, Itera Studio LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill. Our total liability for any claim relating to SoulSaga is limited to the amounts you paid to Itera for SoulSaga in the twelve (12) months before the claim. Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the minimum permitted by law.
9. Indemnification
You agree to defend and indemnify Itera Studio LLC and its officers, directors, and agents against claims, damages, and expenses (including reasonable attorneys’ fees) arising from your content, your misuse of SoulSaga, or your violation of these Terms or applicable law.
10. Governing law
These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law rules. Courts located in Wyoming have exclusive jurisdiction, except that mandatory consumer protections in your country of residence (including in the EEA/UK) remain available where they cannot be waived.
